ACCEPTANCE

1. This page tells you the terms and conditions on which you as a registered user (the User) may make use of MHC Aviation’s website ‘www.mhcaviation.com’ (the Website), including, without limitation, articles, text, photographs, images, illustrations, audio clips, video clips, computer software and code (the "Content"). Please read these terms and conditions carefully before you start to use the Website.

2. mhcaviation.com is a website operated by MHC Aviation SIA (“we” or “us” – the owner and the operator). We are a limited company with offices registered in Vienibas gatve,109 - Riga, Latvia under company number No. 40203254052.

3. By using the Website, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using the Website.

4. MHC Aviation may revise these terms at any time by updating this posting. Use of the Website after such changes are posted will signify your acceptance of these revised conditions. You should visit this page periodically for reviews.

5. mhcaviation.com goal is to connect aviation professionals to be more dynamic and affluent, and its Services are designed to promote economic opportunity for the Users by enabling them to meet, exchange ideas, learn, and find opportunities, individuals or suppliers, work, and make decisions in a network of trusted relationships.

USER ACCOUNT & SERVICES

6. Access to the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Website without notice. We will not be liable if for any reason, including but not limited to the resolution of technical problems, routine maintenance or improvement, the Site is unavailable at any time or for any period.

7. From time to time, we may restrict access to some parts of the Website, or the entire Website, to users who have registered with us.

8. The User may be one of the following two groups:

1. a person who is looking for a new job or is interested in new career opportunities (the Candidate); or

2. a company who is looking for service/features and willing to be contacted by MHC Aviation dedicated team (the Company).

9. The Candidate in mhcaviation.com is represented by the User account with the following required data: first name, last name, e-mail address, phone number and password.

10. The Candidate is the account holder and agrees to: (1) choose a strong and secure password; (2) keep its password secure and confidential; (3) not transfer any part of its account (e.g., connections) and (4) follow applicable laws, including the Laws of Latvia, and these General Terms and Conditions. The Candidate is responsible for anything that happens through its account unless the Candidate closes it or reports misuse.

11. If the Candidate chooses, or is provided with, a user identification code, password, or any other piece of information as part of our security procedures, he must treat such information as confidential and he must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by him/her or allocated by us, at any time, if in our opinion the Candidate has failed to comply with any of the provisions of these terms of use.

12. The Candidate must notify us immediately if he/she knows or believes that the password is in the possession of someone else or if it is being or may be used in an unauthorised way.

13. We will not be liable for any loss that may incur as a result of someone else using the password or account, either with or without the Candidate’s knowledge. However, the Candidate could be held liable for losses incurred by us or another party due to someone else using the account or password.

14. The Services are not for use by anyone under the age of 18 (even if it is a representative of a legal entity) (the Minimum Age).

15. To use the Services, the Candidate agrees that: (1) he must be the Minimum Age or older; (2) he will only have one mhcaviation.com account, which must be in his real name; and (3) he is not already restricted by mhcaviation.com from using the Services. Creating an account with false information is a violation of these General Terms and Conditions, including accounts registered on behalf of others or persons under the age of 18. We reserve the right to close without notice accounts registered with someone else’s email address or with temporary email addresses.

16. The Candidate is responsible for any information submitted to the website and for ensuring that all supplied information is true, accurate, up-to-date, and not misleading or likely to mislead or deceive. Please refer to MHC Aviation Privacy Policy for details

17. The Candidate has an opportunity to subscribe to mhcaviation.com job alerts, however, only after applying for a new job. Subscriptions can be made only by filling the respective subscription request with the following data (*required fields): e-mail* and job role* (position interested in).

STORING AND SHARING

18. The personal information shared by the Candidate in its account, Candidate’s Applications made are stored in:

1. MHC Aviation databases, which are monitored in the MHC Aviation IT infrastructure; and/or

2. Third party mailing services.

19. The Candidate’s files uploaded while applying for a new job are saved and stored in in the mhcaviation.com data servers.

20. The personal information shared by the Candidates in their account can be accessed (seen, copied, and processed for the Service provision) by:

1. MHC Aviation Administrators can view user’s personal data (except the password) on mhcaviation.com web-based platform.

2. User Candidate itself.

3. MHC Aviation Partner’s Recruiters, if and only if, the Candidate sent an application to the Recruiter. The Candidate’s personal data is sent to the Recruiter only after successful application. The Candidate’s personal data received by the Recruiter may be further processed (copied and transferred to any third party) only for such Candidate’s recruitment purposes.

21. The Candidate’s CV data and uploaded files are duplicated to MHC Aviation CRM system that can be accessed (seen, copied, and used for the Service provision) by:

1. MHC Aviation CRM users: e.g., HR-Recruiters, HR admin, Admin, Data Miner, Data Miner Admin.

2. User Candidate itself.

3. MHC Aviation Partner’s Recruiter (View), if and only if, the Candidate sent application to the Recruiter. Application with CV data (.pdf documents) is:

1. sent via email.

2. seen on the Recruiter’s dashboard accessed in MHC Aviation CRM system; or

3. sent via email to Third Parties Services

22. Subscriptions’ data can be accessed by MHC Aviation individuals responsible for mailing campaigns and MHC Aviation CRM users with any roles.

23. MHC Aviation is not obligated to publish any information or content on its Service and can remove it in its sole discretion, with or without notice.

MHC AVIATION.COM DISCLAIMER OF WARRANTIES

24. The Website and the content are provided “AS IS”. While MHC Aviation endeavours to provide information that is correct, accurate and timely, MHC Aviation makes no representations or warranties, express or implied, regarding the website and the content including, without limitation, no representation or warranty that:

1. the content contained in or made available through the website will be of marketable quality and fit for a particular purpose.

2. the website or content will be accurate, complete, current, reliable, or timely.

3. that the operation of the website will be uninterrupted or error-free.

4. that defects or errors on the website or the content, be it human or computer errors, will be corrected.

5. that communications to or from the website will be secure and/or not intercepted.

UPLOADING MATERIAL TO THE WEBSITE

25. Whenever you make use of a feature that allows you to upload material to the Website, or to contact other users of the Website, you must comply with the standards content set out in our Privacy Policy.You declare that any such contribution does comply with those standards, and you indemnify us for any breach of compliance.

26. We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the website. We have the right to remove any material or posting you make on the Website if, in our opinion, such material does not comply with the content standards set out in our Privacy Policy.

LINKS

27. You may link to MHC Aviation home page, in a way that is fair and legal and does not damage our reputation or take advantage of it, though you must not create a link that will suggest any form of association, approval, or endorsement on our part where none exists.

28. You must not create a link from any website that is not owned by you.

29. The Website must not be framed on any other website, nor may you create a link to any part of the Website other than the home page. We reserve the right to withdraw linking permission without notice. The Website from which you are linking must comply in all respects with the content standards set out in our T&C and Privacy Policy.

31. Where the Website contains links to other websites and resources provided by third parties, these links are provided for your information only as a convenience to users. We have no control over the contents of those websites or resources and accept no responsibility for them or liability for any loss or damage that may arise from your use of them and your use of those websites and resources shall be entirely at your own risk.

OWNERSHIP, RIGHTS AND LIMITS

Ownership

32. MHC Aviation is the owner or the licensee of all intellectual property rights in www.mchaviation.com, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

33. You may print off one copy, and may download extracts, of any page(s) from the Site for your personal reference and you may draw the attention of others within your organisation to material posted on the Site.

34. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

35. Our status (and that of any identified contributors) as the authors of material on the Site must always be acknowledged.

36. You must not use any part of the materials on the Site for commercial purposes without obtaining a prior licence to do so from us or our licensors.

37. No framing, harvesting, “scraping” or other manipulation of the material on the Site is permitted without obtaining a prior licence to do so from us or our licensors.

38. You must not, nor attempt to, decipher, disassemble, reverse engineer, or modify any of the software, coding or information comprised in the Site.

39. If you print off, copy, or download any part of the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Rights Granted

40. The right to access, store, process and use any information and personal data that the User provides in accordance with the terms of the Privacy Policy.

Service Changes and Availability

41. mhcaviation.com is not a storage service. The User agrees that mhcaviation.com has no obligation to store, maintain or provide the User a copy of any content or information that the User provides, except to the extent required by applicable law and as noted in mhcaviation.com Privacy Policy.

42. The User acknowledges and agrees that it is impossible to achieve 100% availability of the mhcaviation.com Website. Mhcaviation.com shall however endeavour to keep mhcaviation.com Website available without interruption. Events related to maintenance, security, or capacity requirements, and/or events beyond mhcaviation.com control (e.g., disruptions to public communications networks, power failures, etc.), may result in malfunctions of or temporary interruptions to the service provided on mhcaviation.com Website.

43. mhcaviation.com may change or discontinue any of its Services. MHC Aviation does not promise to store or keep showing any information and content that the User has provided throughout mhcaviation.com.

44. MHC Aviation plans to update the Website regularly and may change the content whenever the need arises. In addition, the access to the Website may be suspended, or indefinitely closed. Any of the material on the Website may be out of date at each instant time, and MHC Aviation has no obligation to update such material.

Limits and Changes to the Services

45. MHC Aviation reserves the right to limit the User’s use of the Services. MHC Aviation reserves the right to restrict, suspend, or terminate the User’s account if mhcaviation.com believes that the User may be in breach of these General Terms and Conditions or law or is misusing the Services (e.g., violating any of the obligations or policies).

46. MHC Aviation reserves the right to modify the offered Services on the mhcaviation.com Website or to offer different Services from those offered at the time of the User’s registration at any time to the extent MHC Aviation is obliged, ensuring that the Services are complaint with the legislation.

47. Modifications that only have a minor impact on mhcaviation.com functionality do not represent changes to the Services described in this section. This shall apply to changes of a purely graphical nature and to a change of layout and/or placement of features.

USER’S ACKNOWLEDGEMENTS AND OBLIGATIONS

48. The User is obliged to only provide content or information that does not violate the law nor anyone’s rights (including intellectual property rights). The User also obligates to secure that the User’s account information would be truthful. MHC Aviation may be required by law to remove certain information or content.

49. By using the Services, the User may encounter content or information that might be inaccurate, incomplete, delayed, misleading, illegal, offensive, or otherwise harmful. MHC Aviation generally does not review content provided by the Users. Therefore, the User hereby agrees that MHC Aviation is not responsible for the Users’ content or information.

50. The User may report any activities of any other User which violate applicable laws and/or any of these General Terms and Conditions.

51. The User acknowledges and agrees that:

1. MHC Aviation.com is not obliged to prohibit third parties from saving data or content that is or was publicly available pursuant to these General Terms and Conditions, MHC Aviation Privacy Policy or Cookie Policy.

2. MHC Aviation merely provides the User with a platform and is not involved in the recruitment process. Users data are sent over the MHC Aviation Partner Companies to be processed. Mhcviation.com shall not be liable for breaches of duty in relation to agreements entered into between the Users and the Partner companies.

52. The User is obliged to:

1. comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws, and regulatory requirements.

2. provide accurate information to MHC Aviation and keep it updated.

3. use its real name on its account; and

4. use the Services in a professional manner.

53. The User is obliged not to:

1. create a false identity on mhcaviation.com, misrepresent its identity, create the User account for anyone other than itself (a real person), or use or attempt to use another’s account.

2. develop, support, or use software, devices, scripts, robots, or any other means or processes to scrape the Services or otherwise copy profiles and other data from the Services.

3. override any security feature or bypass or circumvent any access controls or use limits of the Service.

4. copy, use, disclose or distribute any information obtained from mhcaviation.com, whether directly or through third parties, without the consent of mhcaviation.com.

5. disclose information that the User does not have the consent to disclose (such as confidential information of others (including its employer).

6. violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets, or other proprietary rights.

7. violate the intellectual property or other rights of mhcaviation.com, including, without limitation, (i) copying or distributing mhcaviation.com technology, unless it is released under open-source licenses; (ii) using the word “mhcaviation.com” or mhacaviation.com logos in any business name, email, or otherwise.

8. misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. Shall not attempt to gain unauthorised access to the Website, the server on which the Website is stored, or any server, computer or database connected to the Website. Shall not attack the Website via a denial-of-service attack or a distributed denial-of service attack.

9. reverse engineer, decompile, disassemble, decipher, or otherwise attempt to derive the source code for the Services or any related technology that is not open source.

10. imply or state that you are affiliated with or endorsed by MHC Aviation without our express consent.

11. rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without MHC Aviation consent.

12. overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring an advertisement included on the Services); and/or

13. interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms).

54. By breaching the above provision, you would commit a criminal offence under Latvian law. We will report any such breach to the relevant law enforcement authorities, and we will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.

55. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data, or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any website linked to it.

Termination of Contract

56. Both the User and MHC Aviation may terminate these Terms and Conditions at any time with notice to the other. To protect the User from unauthorised deletion of its account by third parties, we may perform an identity check upon termination, e.g., by requesting the username and an e-mail address registered on the Website.

57. On termination, the User loses the right to access or use the Services.

Disclaimer and Limit of Liability

58. The material displayed on the Website is provided without any guarantees, conditions, or warranties as to its accuracy.

59. To the extent allowed under law, MHC Aviation and its affiliates (and those that mhcaviation.com works with to provide the services) (a) disclaim all implied warranties and representations (e.g., warranties of merchantability, fitness for a particular purpose, accuracy of data, and non infringement); (b) do not guarantee that the Services will function without interruption or errors, and (c) provide the Service (including content and information) on an “as is” and “as available” basis.

60. To the extent permitted under law (and unless MHC Aviation has entered into a separate written agreement that overrides these General Terms and Conditions), MHC Aviation and its affiliates (and those that mhcavitian.com works with to provide the Services) shall not be liable to the User or others for any indirect, incidental, special, consequential or punitive damages, or any loss of data, opportunities, reputation, profits or revenues, related to the Services (e.g. offensive or defamatory statements, down time or loss, use of, or changes to, your information or content).

61. In addition, mhcaviation.com shall be liable without limitation for damages due to intent or gross negligence by MHC Aviation.

APPLICABLE LAW

62. MHC Aviation is permitted to commission sub-contractors but remains responsible for fulfilling its duties.

63. To the extent allowed by law, the English language version of these Terms and Conditions is binding and other translations are for convenience only. These Terms and Conditions (including additional terms that may be provided by MHC Aviation) is the only agreement between the User and MHC Aviation regarding the Services and supersedes all prior agreements for the Services.

64. If MHC Aviation does not act to enforce a breach of these Terms and Conditions, that does not mean that MHC Aviation has waived its right to enforce these Terms and Conditions.

65. MHC Aviation is permitted to transfer rights and duties stipulated herein to third parties, in whole or in part. However, the User may not assign, or transfer rights and duties stipulated herein (or its membership or use of Services) to anyone without MHC Aviation consent.

66. These Terms and Conditions and the contractual relationship shall be governed by Latvian law, excluding international private law and the provisions of the United Nations Convention on Contracts for the International Sale of Goods that have been adopted by Latvian law.

67. The User and MHC Aviation agrees that claims and disputes can be litigated only in Riga, Latvia, and each of the parties agree to personal jurisdiction of the courts located in Riga, Latvia.
